Terms of Service

By using Aurashot you agree to these terms. Aurashot is provided by Carve LLC, a Colorado limited liability company. If you do not agree to these terms, please do not use the app.

What Aurashot is

Aurashot rates the aura of a photo: how you present yourself in it, meaning your styling, pose, setting and framing. It gives you coaching to look better in your photos. It does not rate physical attractiveness and is not a judgement of how anyone looks.

Who can use Aurashot

• You must be at least 13 years old.
• If you are under 18, you may use Aurashot only with the involvement of a parent or guardian, and they must agree to these terms on your behalf.
• Where state law requires it, the App Store asks for parental consent before a minor downloads an app or makes a purchase, and tells us the account's age category. If a parent or guardian withdraws consent, access ends. We receive a category, never a birth date. See our Privacy Policy.
• You must not use Aurashot if a previous account or device of yours was suspended by us.

Your photos

You must have the right to use any photo you upload, and everyone shown in it must be comfortable with you doing so. Do not upload sexual or explicit content, content involving minors in any sexual context, illegal content, or photos of people who have not agreed to it. We may refuse to score any image. How photos are handled is described in our Privacy Policy.

Subscriptions

• Aurashot Pro is $3.99 per week or $99.99 per year. There is no free trial; you are charged when you subscribe.
• Subscriptions renew automatically until cancelled. You can cancel any time in your Apple Account settings; cancelling takes effect at the end of the current period.
• Payment is charged to your Apple Account. Purchases, renewals and refunds are handled by Apple under their terms, and we cannot issue refunds directly.
• Pro includes up to 21 scores per week. This limit exists because every score costs us a real AI call.
• We may change prices. A price change never affects a period you have already paid for, and Apple will ask you to agree before any increased renewal is charged.

The free score and the invite program

• Everyone gets one free score, once, per device. Your score and your card are free and always will be.
• The full result for that photo, meaning the individual dimension scores and the coaching, is locked. It unlocks in one of two ways: by subscribing to Aurashot Pro, or by one friend installing Aurashot through your invite link. A friend counts when they install on a device that has not used Aurashot before.
• A friend who installs through your link gets their own free result unlocked as well.
• An invite unlocks a result you already have. It never grants additional scores and it is not a subscription.
• The unlock is a promotional benefit. It has no cash value, cannot be transferred, sold or exchanged, and we may change the number of friends required, or modify or discontinue the program at any time. A result already unlocked stays unlocked.
• Inviting yourself, using multiple devices to fake invites, or otherwise gaming the program will forfeit the unlock.

Acceptable use

Do not attempt to bypass the app, tamper with our service, automate or script requests, resell access, reverse engineer the app except where the law allows it, or use Aurashot to harass anyone or to upload images of people without their agreement. We may suspend or end access that abuses the service.

Our intellectual property

Everything we made, including the app, the name, the card design, the wordmark and the rubric behind the score, belongs to Carve LLC and is protected by copyright and trademark law. We grant you a personal, revocable, non-exclusive, non-transferable licence to use the app as intended. You may not copy, modify, distribute, or create derivative works from it.

Your content and the cards you share

You keep all rights to your photos. Result cards you create are yours to post anywhere you like. We do not publish, share or display your photos to anyone else. Sharing only ever happens when you choose to share. You grant us only the permission needed to process your photo in order to produce your score, which ends when the request ends.

The App Store

These terms are between you and Carve LLC only, not with Apple. Carve LLC, not Apple, is solely responsible for Aurashot and its content.

• Your licence to use Aurashot is limited to non-transferable use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service, including the Family Sharing rules there.
• Apple has no obligation to provide maintenance or support for Aurashot.
• If Aurashot fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation in relation to Aurashot.
• Carve LLC, not Apple, is responsible for addressing any claim relating to Aurashot, including product liability claims, any claim that it fails to conform to a legal or regulatory requirement, claims under consumer protection or similar law, and any third-party claim that Aurashot infringes intellectual property rights.
• You confirm you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using Aurashot.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, on your acceptance, have the right to enforce them against you.

Availability

We aim to keep Aurashot working, but it depends on third-party AI providers and can be unavailable or slow. Scores may occasionally fail; a failed or refused score never uses up your free score or a weekly score. We may change, suspend or discontinue any part of the app.

Suspension and termination

You can stop using Aurashot at any time by deleting it, and cancel any subscription through your Apple Account. We may suspend or end your access if you breach these terms or abuse the service. Sections that by their nature should survive, including intellectual property, disclaimers, liability, indemnification, governing law and dispute resolution, survive termination.

Disclaimer

Aurashot is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any score, coaching or other output is accurate, complete or suitable for any purpose. Scores are entertainment and reflect an AI model's subjective reading of a photograph.

Limitation of liability

To the fullest extent permitted by law, Carve LLC is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, arising from your use of Aurashot. This applies even if we have been advised such damages are possible.

Our total liability for any claim relating to Aurashot is limited to the greater of the amount you paid us in the twelve months before the claim, or $50 USD.

Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these terms limits liability that cannot lawfully be limited.

Indemnification

You agree to indemnify and hold harmless Carve LLC from any claim, loss or expense (including reasonable legal fees) arising from your misuse of Aurashot, your breach of these terms, or your uploading of any photo you did not have the right to use.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Subject to the arbitration section below, the state and federal courts located in Colorado have exclusive jurisdiction.

Dispute resolution: arbitration and class-action waiver

• Talk to us first. Email us and give us 30 days to resolve the problem informally. Most things end here.
• Binding arbitration. If we cannot resolve it, any dispute arising out of or relating to Aurashot or these terms will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Judgment on the award may be entered in any court with jurisdiction.
• Class-action waiver. Disputes will be brought only in your individual capacity, and not as a plaintiff or class member in any class, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims.
• Exceptions. Either of us may bring an individual claim in small-claims court, and either of us may seek injunctive relief to protect intellectual property rights.
• You can opt out. If you do not want this arbitration agreement to apply, email us within 30 days of first accepting these terms, saying that you opt out of arbitration and identifying the Apple Account email you use. Opting out costs you nothing and does not affect anything else in these terms.

Notice to California residents

Under California Civil Code section 1789.3, California residents are entitled to the following. Aurashot is provided by Carve LLC, 1500 North Grant Street, Suite N, Denver, CO 80203. Aurashot Pro costs $3.99 per week or $99.99 per year; the first score is free. To resolve a complaint about the service or to receive further information, email us at the address at the bottom of this page. The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

General

If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours in connection with a merger, acquisition or sale of assets. These terms, together with the Privacy Policy, are the entire agreement between us about Aurashot. You agree we may communicate with you electronically, and that electronic agreements and notices satisfy any legal requirement that they be in writing.

Changes

We may update these terms; material changes will be posted here with a new date. Continuing to use Aurashot after a change means you accept the updated terms.
